Welcome to My Ethnicity. These Terms of Service govern your use of the My Ethnicity mobile application provided by Visorya. By creating an account or using the App, you agree to these terms. Please read them carefully.

Important: My Ethnicity provides AI-generated content for entertainment and exploration purposes only. The results — including ethnic origin analyses, past portraits, ancestor galleries, ancestral lifestyles, and ideal partner suggestions — are NOT scientific, medical, genetic, or genealogical determinations. They do not replace DNA testing, professional ancestry research, dating advice, or any other professional service.

1. Acceptance of Terms

By downloading, installing, accessing, or using My Ethnicity (the "App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the App.

These Terms constitute a binding agreement between you and Visorya ("we," "us," "our"), the operator of My Ethnicity.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use My Ethnicity.

If you are between the minimum age and the age of majority where you live, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You must have legal capacity to enter into a contract.

You must not be barred from using the App under applicable laws.

3. Account Registration

You may register using email and password, Google Sign-In, or Apple Sign-In.

You agree to provide accurate, current, and complete information.

You are responsible for maintaining the confidentiality of your credentials.

You are responsible for all activities under your account.

You must notify us immediately of any unauthorized use of your account.

One account per person. Creating multiple accounts to circumvent limits or restrictions is prohibited.

4. Description of Service

My Ethnicity is an AI-powered mobile application that analyzes user-submitted selfies to generate creative outputs for entertainment, including:

Ethnic Origin Analysis: AI interpretation of facial features mapped to possible cultural patterns.

Past Portrait: AI-generated portraits depicting how the user might have appeared in different historical eras.

Ancestor Gallery: AI-generated portraits across various stylistic categories.

Ancestral Lifestyle: AI-generated narratives about historical living conditions associated with cultural patterns.

Ideal Partner Analysis: AI-generated portraits based on user-provided preferences.

Features may be modified, added, or discontinued at our discretion. We will provide reasonable notice for significant changes.

5. Important Disclaimer About AI Results

My Ethnicity is for entertainment purposes only.

Outputs are creative AI interpretations, not scientific, medical, genetic, or genealogical facts.

My Ethnicity does not perform DNA analysis, genetic testing, or actual ancestry determination.

Results should not be relied upon for any legal, medical, identification, immigration, employment, or other consequential purposes.

Ideal Partner outputs are not dating advice, compatibility predictions, or psychological assessments.

Past Portraits and Ancestor Gallery images are fictional creations and not photographs of real ancestors.

Cultural and ethnic interpretations are simplifications and should not be used to make assumptions about individuals or groups.

6. User Content and Photos

6.1 Your Content

You retain all ownership rights to photos and content you upload to My Ethnicity ("User Content"). You are solely responsible for the content you upload.

6.2 Content Standards

By uploading content, you represent and warrant that:

You own or have the necessary rights to upload the content.

If the photo includes another person, you have their explicit permission to upload their image.

Content does not violate any third-party rights (including intellectual property, privacy, or publicity rights).

Content is not illegal, defamatory, obscene, threatening, harassing, hateful, or otherwise objectionable.

Content does not include images of minors without verifiable parental consent.

6.3 License You Grant Us

By uploading content to My Ethnicity, you grant Visorya a worldwide, non-exclusive, royalty-free, sub-licensable license to host, store, process, transmit, modify, and display your content solely for the purpose of providing the App's features to you. This license terminates when you delete the content or your account, except where retention is required by law or for legitimate backup purposes.

7. License to Use the App

Subject to these Terms, we grant you a limited, personal, non-transferable, non-exclusive, revocable license to use My Ethnicity for your personal, non-commercial use. You may not:

Copy, modify, distribute, sell, or lease the App or any portion of it.

Reverse engineer, decompile, or attempt to extract source code.

Use the App to develop a competing product or service.

Use automated systems, scrapers, or bots to access the App.

Bypass technical limitations or access controls.

Remove or alter any proprietary notices.

8. Subscriptions and Pro Membership

8.1 Subscription Plans

My Ethnicity offers Pro membership through weekly, monthly, and yearly subscription plans. Subscriptions unlock unlimited analyses, all visual styles, HD portrait downloads, and priority processing.

8.2 Billing

Subscriptions are billed through your Apple ID account.

Payment is charged at confirmation of purchase.

Prices are displayed in the App and may vary by region and over time.

8.3 Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen plan.

You can manage subscriptions and turn off auto-renewal in your Apple ID account settings.

8.4 Free Trials

If a free trial is offered, the unused portion of the trial period (if any) is forfeited when you purchase a subscription, where applicable by law.

8.5 Price Changes

We may change subscription prices. Price changes apply at the start of the next subscription period after we provide reasonable notice. Continued use after a price change constitutes acceptance.

9. Cancellation and Refunds

You can cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period; you retain access to Pro features until then.

Refund requests are governed by the Apple App Store refund policy. We do not directly issue refunds for purchases made through the App Store.

To request a refund, contact Apple Support directly through your Apple ID purchase history.

EU/UK consumers may have additional statutory withdrawal rights under applicable law.

10. Acceptable Use

You agree not to:

Use the App for any illegal purpose or to violate any laws.

Upload photos of other people without their consent.

Upload content that is harmful, offensive, hateful, sexually explicit, or violent.

Impersonate any person or misrepresent your identity.

Use the App to harass, abuse, or harm others.

Use AI-generated outputs to defame, harass, deceive, or impersonate others.

Use the App in any way that could disable, overburden, damage, or impair its functionality.

Use the App to discriminate against any individual or group.

Attempt to access accounts or data not belonging to you.

Submit fraudulent or fake content.

Resell, redistribute, or commercially exploit AI outputs without our written consent.

11. AI-Generated Content

AI-generated outputs are produced by automated systems and may not be accurate, complete, or appropriate in every context.

You acknowledge that AI outputs are creative interpretations and not factual statements.

You agree to use AI outputs responsibly and not to misrepresent them as real photographs of yourself or others, particularly in contexts that could mislead third parties (such as dating profiles, official documents, journalism, or political content).

We do not guarantee that AI outputs are unique, original, or non-similar to other AI outputs generated for other users.

You are solely responsible for how you use, share, or publish AI outputs.

12. Intellectual Property

12.1 Our Rights

My Ethnicity — including its software, design, branding, trademarks, logos, and all related content (excluding User Content) — is owned by Visorya and protected by copyright, trademark, and other intellectual property laws. All rights are reserved.

12.2 AI-Generated Outputs

Subject to your compliance with these Terms, you may use AI-generated outputs (portraits, analyses) created from your own uploaded photos for personal, non-commercial purposes. Commercial use requires our prior written consent.

12.3 Feedback

If you provide suggestions, feedback, or ideas about the App, you grant us a perpetual, royalty-free, worldwide license to use them without restriction or compensation.

13. Privacy

Your privacy is important to us. Our handling of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Third-Party Services

My Ethnicity integrates with third-party services (Apple, Google, AI providers, cloud hosting, etc.). Your use of those services is subject to their respective terms and policies. We are not responsible for third-party services, their availability, or their content.

15. Termination

15.1 Termination by You

You may stop using My Ethnicity and delete your account at any time through the App settings ("Close My Account").

15.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you:

Violate these Terms.

Engage in fraudulent or abusive behavior.

Pose a risk to other users or to Visorya.

Fail to pay subscription fees.

15.3 Effect of Termination

Upon termination, your right to use the App ceases. Sections that by their nature should survive termination (disclaimers, intellectual property, liability limits, indemnification, governing law) will continue in effect.

16. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUTS.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI RESULTS WILL BE ACCURATE, MEANINGFUL, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

Some jurisdictions do not allow the exclusion of certain warranties; in such cases, the above disclaimers apply to the maximum extent permitted by law.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISORYA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, the above limitations apply to the maximum extent permitted by law.

18. Indemnification

You agree to indemnify, defend, and hold harmless Visorya and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the App.

Your violation of these Terms.

Your User Content.

Your violation of any rights of another person or entity.

19. Changes to These Terms

We may modify these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date and providing in-app notice or email. Your continued use of the App after changes constitutes acceptance. If you do not agree with the updated Terms, you must stop using the App.

20. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the competent courts of Istanbul, Türkiye, unless a different forum is required by applicable consumer protection law.

If you are an EU/UK consumer, this clause does not deprive you of mandatory consumer protections under the law of your country of residence, and you may bring claims in the courts of that country.
